TERMS OF SERVICE

1. Acceptance of Terms

By accessing or using Const-Rapid Construction Limited’s milestone-based construction platform (“the Platform”), you agree to these Terms of Service. If you do not agree, do not use the Platform.

These Terms are issued under the Companies Act, 2019 (Act 992) and the Electronic Transactions Act, 2008 (Act 772).

2. Eligibility Requirements

• You must be at least 18 years old.
• Ghana Card or Voter ID is required for identity verification.
• Contractors must provide valid trade licenses and SSNIT numbers.
• Project owners must provide accurate regional addresses for service delivery.

3. Description of Services

Const-Rapid provides:

• Milestone-based project tracking
• Secure storage of task photos, receipts, and payment records
• Contractor and owner matching within Ghana’s 16 regions
• Automated WhatsApp notifications for project updates
• DPA-approved data processing and secure storage in Accra

4. Account Responsibilities

• You must maintain accurate and updated information.
• Two-factor authentication (2FA) must be enabled.
• You are responsible for all activity performed using your login credentials.

5. Milestone Payments

Const-Rapid uses a secure milestone release system:

• Payments are released only after verification of task photos and receipts.
• Mobile Money (MTN, Vodafone, AirtelTigo) and bank transfers are supported.
• We verify transactions with payment providers but do not store full MoMo details.
• All payment data stored for 7 years to meet Ghana Revenue Authority (GRA) rules.

6. Contractor Obligations

• Provide truthful license documents and project portfolios.
• Upload accurate, real-time milestone verification photos.
• Communicate promptly with project owners via WhatsApp/Platform.
• Abide by regional regulations of the District Assembly where the project resides.

7. Project Owner Responsibilities

• Provide correct project details and location information.
• Review milestone submissions promptly.
• Ensure payment accounts (MoMo/Bank) are legally owned and authorized.
• Cooperate with contractor for inspections and approvals.

8. Prohibited Activities

• Uploading fraudulent photos or altered receipts
• Impersonation using another person’s Ghana Card or SSNIT
• Bypassing milestone verification processes
• Harassment of contractors, staff, or project owners
• Attempting to hack or breach platform security

9. WhatsApp Communications

We use the WhatsApp Business API to send milestone updates, project alerts, and verification notices.

• Messages are end-to-end encrypted.
• Meta stores messages for up to 30 days.
• Users may opt-out of WhatsApp notifications at any time.

10. Data Ownership & Intellectual Property

• Milestone photos and receipts remain the property of the project owner.
• The platform UI, algorithms, and brand are owned by Const-Rapid Construction Ltd.
• Users grant us a license to process project data solely for service delivery.

11. Limitation of Liability

Const-Rapid Construction Ltd is not liable for:

• Disputes between project owners and contractors
• Delays caused by weather, transport, or supplier shortages
• Losses from misuse of the platform or account negligence
• Mobile Money or bank processing failures

Liability is limited to the amount paid to us for the affected milestone service.

12. Account Suspension & Termination

• We may suspend accounts involved in fraud or safety risks.
• Users may delete their accounts anytime.
• Data retention follows DPA Act 843 guidelines.

13. Dispute Resolution

Disputes shall first undergo internal mediation. If unresolved:

• Matters go to the appropriate District Assembly mediation process.
• Final jurisdiction is the High Court of Ghana.

14. Governing Law

These Terms are governed by the laws of the Republic of Ghana, including:

• Companies Act, 2019 (Act 992)
• Electronic Transactions Act, 2008 (Act 772)
• Data Protection Act, 2012 (Act 843)

15. Changes to Terms

We may update these Terms and will notify users 30 days in advance via SMS or WhatsApp.
